Terms of Service
(The following Terms of Service contain as well legal information about your rights according to the regulations about contracts in distance selling and electronic trading.)
1. Scope
These Terms of Service (ToS) are valid for all deliveries made by Positive Vibrations – Didgeridoo & More (owner: Bernhard Pfeil), Rablstr. 37, 81669 Muenchen, Germany

3. Offer and Conclusion of Contract
The product presentation in the online shop does not constitute a legally binding offer, but a prompt for ordering. Errors excepted.
By click on the button [Buy now] you are giving a binding order of the products listed on the Confirm order page. The contract will be established when we accept your order by sending an Acceptance of Order statement via email.
4. Withdrawal
4.1 Customers have a 14 days right for withdrawal.

Conditions for Withdrawal
You have the right to cancel the contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the date on which you or a third party named by you, which is not the carrier, have taken physical possession of the goods.
In order to exercise your right of cancellation, you have to contact us (Positive Vibrations - Didgeridoo and More, Bernhard Pfeil, Rablstr. 37, 81669 Muenchen, Germany. E-mail webmaster@didgeridoo-onlineshop.de, +49-162-9250493) by means of a written statement (e.g., sent by mail or email) or by phone (requires written confirmation from our side by E-mail) and inform us about your decision to withdraw from the contract. You may use the attached withdrawal form, which is not mandatory, however.
In order to observe the withdrawal period it is sufficient for you to send the withdrawal notification within the withdrawal period.
Effects of withdrawal
If you withdraw from this contract, we return all received payments covered by this contract with respect to those goods you want to return. This includes delivery costs (with the exception of additional costs arising from the fact that you have chosen a type of delivery other than the least expensive standard delivery offered by us for this type of product or the assembly of products as listed in the contract). For repayment, we use the same method of payment that you used for the initial transaction, unless you explicitly agreed otherwise; in any case you will not be charged any repayment fees. Repayment will be within 14 days after reception of the withdrawal notification. We may withhold the repayment until we have received the goods back or until you have demonstrated that you have returned the goods, whichever is the earlier.
You have to return the goods promptly and in any case not later than fourteen days counted from the date of your notification of the cancellation of this contract to us. The deadline is met if you send back the goods before the period of fourteen days ends.
You have to bear the direct costs of returning the goods.
You only need to pay for any diminished value of the goods when such loss in value is due to any improper handling not necessary to ascertain the nature, characteristics and functioning of the goods.

4.2 The Right of Withdrawal does not apply
- to goods that are not prefabricated and were produced in accordance an individual choice or decision by the customer or which are clearly tailored to the personal needs of the customer
- sealed goods which are not qualified for return due to health regulations and/or hygiene considerations, when the sealing has been removed
- books, sound or video takes, computer software in seald packaging when the sealing has been removed
5. Prices and Delivery Fees
5.1 The prices stated on the product pages contain the German VAT and possible other .
5.2 In addition to the product prices we count in delivery costs depending on the selected goods and type of delivery. Delivery fees are detailled in the webshop at “Delivery fees”. Delivery fees are explicitly stated in the Basket. You may change the preselected value of the delivery fees during the ordering process if necessary and applicable.
5.3 Custom Fees and Local taxes
Depending on the local regulations custom fees and taxes may apply. Knowledge of these regulations and the related costs are sole responsibility of the customer.
6. Payment
6.1 The payment methods supported are

6.2 For Payment in Advance you will receive the details of our bank account in the order confirmation. Delivery will be initiated upon receipt of payment.
7. Delivery
7.1. Worldwide delivery is possible in accordance with export regulations. For those countries or regions not explicitly listed an agreement with us has to be established covering the details of delivery and delivery fees before ordering.
7.2 Delivery time is usually 5 working days after receipt of payment. Deviations may occur due to the country and location of the delivery. Known circumstances causing deviating delivery times are stated on the frontpage of the webshop.
8. Reservation of Proprietary Rights
We reserve ownership of the material until full payment including policy fees and taxes has been made.
9. Alternative Dispute Resolution
The European Commission offers a platform for extrajudicial online dispute resolution (ODR) that can be accessed via http://ec.europa.eu/odr.
10. Ordering Process
If you have chosen the product you want, you can add this selection without obligation by clicking the button [Add to shopping basket] to the shopping cart. The contents of the shopping cart can be viewed any time by clicking the button [Basket] or [Display shopping basket]. The products can be removed from the shopping cart any time by clicking the button with the trash icon. If you want to buy the products in your cart, click the button [Check out]. You may then select whether to register and order as a registered customer or whether to order without registration. Please enter then the required information. The mandatory fields are marked with *. A registration is not a prerequisite for an order. Your data is encrypted. After entering your data, you can change the pre-selected options for shipping method and payment method via a list. Click on the button [Next] to get to the order page where you can check your entries again. By clicking the button [Buy] you complete the ordering process in a commercially binding way. The process can be interrupted at any time by closing the browser window.
11. Text of the contract
The text of the contract is stored on our internal systems. At any time you can see the Terms of Service on our homepage https://www.didgeridoo-onlineshop.de. The order information and the Terms of Service will be sent by e-mail.
12. Registration
If you have decided to register (i. e., create an account) you can view your past orders in our customer login area. Otherwise, you cannot access your order data after completion of your the purchase via the Internet.
